EWA Files Ex Parte on SEC Order

On October 5, 2017, the Enterprise Wireless Alliance (EWA) filed an ex parte letter to bring to the attention of the Federal Communications Commission an Order in a lawsuit brought by the Securities and Exchange Commission (SEC)  that found four defendants “responsible for planning and operating an investment scheme to apply for, obtain, and monetize [FCC] spectrum licenses that…Defendants knew or should have known had little value.”

The spectrum at issue is 800 MHz Expansion Band (EB) and Guard Band (GB) spectrum, the future licensing of which is under consideration. EWA urges the FCC to consider a licensing approach for the EB/GB that would deter parties contemplating similar schemes and that would best serve the
public interest.
