EWA Files Petition for Rulemaking for Elimination of Concurrence Requirement for “Primary Use” Frequencies

The Enterprise Wireless Alliance (EWA) filed on March 23, 2023, a Petition for Rulemaking yesterday which requests the Federal Communications Commission (FCC) to initiate a rulemaking proceeding to modify Rule Sections 90.35(b)(1)-(3) and 90.175(b), eliminating administrative and financial burdens that require Industrial Business (IB) frequency coordinators to secure concurrence on primary use VHF/UHF land mobile radio spectrum licensed by the FCC. Technological advances and enhanced spectrum analytical processes in use today by FCC-certified Frequency Advisory Committees (FACs) have demonstrated these frequencies can be coordinated and utilized safely by all Part 90 IB eligible entities without first having to secure inter-coordinator concurrence.
